Legal Jurisdiction - This Agreement and any disputes, claims or proceedings of whatsoever nature arising shall be governed by and shall be
construed in accordance with the laws of England. The Hirer hereby consents to the exclusive jurisdiction of the English courts in all disputes.
Weekly Hire - All weekly bookings start from 3pm on arrival day and the property must be vacated by 10am latest on the departure day.
Short Breaks Hire - Long weekends and mid week breaks are usually during the off peak periods (October to March). All bookings start from 3pm
on arrival day and the property must be vacated by 10am on departure day so our cleaning staff can prepare the cottage for the next renter.
Deposit / Payment - A deposit of 30% of the full rental is payable when booking unless the booking is being made within 8 weeks of the holiday
commencement date, and then the full amount of the hire charge is payable immediately. If the booking is made within four weeks of the holiday
commencement we can only accept a full cash payment on arrival at cottage. You may make a booking by telephone or e-mail and once the dates
have been agreed, this will be reserved for a maximum of five days. Please ensure that your deposit cheque is received within the 5 days. The
balance is payable not later than 8 weeks before the holiday commencement date. If the balance is not received by the owners by the due date the
deposit will be forfeited and the accommodation re-let.
Cancellation - Once a booking has been confirmed in writing or email and the deposit paid, the hirer is liable for the whole amount of the rent for
the period booked. If written notice of cancellation is received every effort will be made to re-let the cottage for the period booked and if a new let is
arranged then only the deposit will be forfeited. If the cottage cannot be re-let then both the deposit and the balance payable will be forfeited.
Holiday Insurance - Once booked, the hirer is liable for the complete cottage rental costs. As such it is strongly recommend that the hirer take out
suitable holiday insurance to cover costs incurred by unexpected holiday cancellation.
Availability - The booking is made on the understanding that the cottage will be placed at the hirer's disposal on the dates agreed. Should this not
be possible through fire, theft or circumstances beyond the owner’s control then the full amount paid by the hirer will be refunded within 7 days.
Please note that no alternative accommodation can be provided nor will the hirer have any claim against the owner for compensation, loss or
expenses. The accommodation is booked strictly on the basis that it is used for holiday accommodation only and there is no right to remain on the
property after the expiration of the rental period.
Damages/End of Stay cleaning deposit: A £100 damage/cleaning deposit cheque is payable with each booking. The cheque will not be cashed
and will be posted back to you within 7 days of your departure if the cottage and all of its contents are in the same condition as when you rented it
and the cottage is left clean and tidy. If the cottage isn’t left as you find it, you will be charged for the extra work involved in cleaning up after you
and the cost will be taken from your damage/cleaning deposit cheque. We don’t charge for minor breakages like the odd cup, however you will be
charged for major breakages and these will be taken from your damage/cleaning deposit cheque and a copy of the invoice emailed to you. If
outside contractors are required to repair any damage the bill will be passed directly to you to be paid. The owners must be informed immediately
during the holiday of any breakage, damage, loss of keys etc., however minor. The hirer must replace or pay for all damages before the end of the
holiday. Lost keys will be charged at £5 each. The hirer undertakes to keep the cottage and all the furniture, fittings and contents in the same state
of repair and condition as at the commencement of the letting. Should the damage result in another booking being cancelled, the Hirer will be held
liable for all consequential losses to the owner and all bills from contractors will be send for you to pay directly to contractor.
Private Car Park - The Hirer uses the private car park at their own risk at all times. The owner shall not be held responsible for any accidents,
damages or theft to cars/people. We can only accept 2 cars in the private car park. There is some on road parking in the village within 50 yards
Occupation - The hirer shall use the accommodation strictly for private holiday occupation and this agreement shall not confer on the Hirer any
security of tenure within the terms of the Housing Act 1988 pursuant to which the occupation shall be deemed to be by way of an excluded tenancy.
The hirer shall not do or allow to be done anything which may become a nuisance or annoyance to the occupiers of the neighbouring properties.
The hirer shall not allow any person or persons to sleep in or otherwise occupy the accommodation except as specified on the Booking
Confirmation (maximum of 10 people plus 1 baby under 2 years of age in a travel cot). If this condition is not observed, the Owner reserves the
right to refuse admittance or require that the Hirer vacate the property. In this eventuality, no refund of monies will be due.
Repairs - The hirer shall permit the owner to enter the accommodation at any reasonable time of day to inspect the condition of the decorations or
for the purpose of carrying out any repairs that may require to be done.
Acceptance of Booking - The owners reserve the right to refuse any booking without having to give any reason for such decision. We do accept
bookings from groups under 18 years of age.
Safety - The owners take safety very seriously and do everything to ensure the cottage is safe, however. your stay at the cottage is entirely at your
own risk. The owners can take no responsibility whatsoever for any accident, injury or loss, howsoever caused, during your stay. The pushchair is
available to use at your own risk.
Smoking - For safety reasons we do not permit guests to smoke in the cottage.
Service - If you have any problems, whatsoever, during your stay or are dissatisfied with the service you receive, please contact the owners
IMMEDIATELY. All reasonable steps will be taken to correct any problems. The owners will not consider any claims for problems notified to them
AFTER the stay has ended.
Pets - We do not accept any pets or animals in the Cottage or premises. Please note: If any animals are found in the cottage or on the premises
you will be asked to leave immediately with no refund of any monies paid.
Amenities - The use of the Cottage includes gas, electricity, water heating, gas central heating, bed linen, hand towels, tea towels, bath mats,bath
robes, 42 inch widescreen digital colour TV, DVD/Video Player, Full package SKY plus in lounge (this will not include box office movies), High
Speed Broadband Internet, 19 inch widescreen televisions with dvd player & Freeview (in bedrooms). Unfortunately due to the transmitter and local
weather conditions the Freeview signal is sometimes intermittent and unfortunately this is out of our control.
Cleaning - The Cottage and everything on the property must be left clean and tidy at the end of the hire period. A vacuum cleaner, brushes,
cleaning products and materials will be found in the cottage. A cleaning charge, dependant on cleaning needed, will be made otherwise. (Please
Note: It is the Hirer’s responsibility to ensure the safe storage of cleaning materials, particularly in the presence of children).
Left Items - The Hirer will be notified if any of the Hirer’s possessions have been left in the property after it has been vacated. Notice will be made
by email, generally within 14 days after the end of the booking period. The Hirer must meet the cost of returning any item. This must be paid before
the item is returned. If the Hirer does not wish for the item to be returned, the Owners will dispose of the item. Please Note: items to be returned
will be suitably packed but the Owners accept no responsibility for loss or damage in transit.
Security - The Hirer is responsible for the security of the Cottage for the duration of the booking period and also immediately after vacation, until
such time as the Owners and/or their Agents re-enter the Cottage. The Hirer is expected to take all reasonable care of it. This includes ensuring
that the Cottage is fully secured when leaving it. No doors or windows should be left open and all locks must be secure.
Complaints Procedure - If the Hirer is not entirely satisfied with the accommodation offered, they must contact the Owners by phone immediately
(during your stay at the cottage), and every effort will be made to resolve the problem. If the situation cannot be resolved to the satisfaction of both
parties, the Owner will attend as soon as possible to inspect the property. The Owner will not consider claims for problems notified to them after the
hire period has ended.
Variation to descriptions - Every care has been taken to ensure the accuracy of details on the Owners’ literature, advertising, web sites, etc.
However, changes to the details may be necessary from time to time and the Owners reserve the right to make any changes without notice. Where
changes are fundamental to a booking, notification will be made in writing by post or email.
Sale of cottage/business - If the cottage/business is sold then all monies paid will be refunded. You will be informed as soon as possible. The
owner will not be held responsible for loss of your holiday.
